This Privacy Policy describes how NBRLY, owned and operated by Bluefields Group LLC DBA as NBRLY App ("we," "us," or "our"), collects, uses, and protects your personal information when you use our mobile application (the "App").

NBRLY Terms of Use Agreement

1. Acceptance

By accessing or using the NBRLY app, owned and operated by Bluefields Group LLC DBA as NBRLY App ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the app.

2. Eligibility

You must be at least 18 years old to use NBRLY. By using the app, you represent that you are of legal age and have the capacity to enter into this agreement.

3. User Conduct

You agree to use NBRLY in accordance with all applicable laws and regulations. You will not:

  • Use the app for any unlawful or prohibited purpose
  • Use the app to harass, threaten, or abuse others
  • Impersonate any person or entity
  • Post or transmit any content that is offensive, harmful, or illegal

4. Intellectual Property

NBRLY and its content, including but not limited to text, images, and logos, are protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any NBRLY content without our prior written consent.

5. User Content

You may be able to upload or share content through NBRLY. You grant NBRLY a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display your content in connection with NBRLY.

6. Child Safety and Prohibited Content

NBRLY is committed to the safety and well-being of all individuals, particularly children. We have a zero-tolerance policy for child sexual abuse and exploitation (CSAE). We require all users to adhere to the following:

Prohibition of Child Sexual Abuse and Exploitation (CSAE): You are strictly prohibited from using the NBRLY app to create, upload, share, or otherwise distribute content that facilitates the sexual abuse or exploitation of children. This includes, but is not limited to:

  • Any form of child sexual abuse material (CSAM), which consists of any visual depiction of a minor engaging in sexually explicit conduct.
  • Child grooming (befriending a child online for sexual exploitation).
  • Sextortion (threatening or blackmailing a child using intimate images).
  • Sexualization of a minor.
  • Trafficking of a child.

User Reporting and Feedback: To help us maintain a safe community, we provide an in-app mechanism for users to report content or behavior that violates these standards. If you encounter any content or conduct that you believe involves CSAE, please use the in-app reporting tool to submit your concerns to our team.

Addressing Child Sexual Abuse Material (CSAM): We take immediate and appropriate action upon obtaining actual knowledge of CSAM in our app. Our actions, which align with applicable laws and our internal policies, include removing the content and, where legally required, reporting it and the responsible user to law enforcement and the National Center for Missing & Exploited Children (NCMEC) or other relevant regional authorities.

Compliance with Applicable Laws: By using NBRLY, you agree to comply with all relevant child safety laws and regulations. We have established internal procedures to cooperate with law enforcement and regulatory bodies to address confirmed instances of CSAE and CSAM as required by law.

Child Safety Point of Contact: For any official communication from relevant authorities regarding child safety and content moderation, NBRLY has a designated point of contact. This individual is responsible for receiving and responding to official inquiries about our child safety practices and enforcement procedures.

7. Disclaimer of Warranties

NBRLY is provided on an "as is" basis without warranties of any kind. We do not warrant that NBRLY will be error-free or uninterrupted.

8. Limitation of Liability

In no event shall NBRLY be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the app.

9. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of New York, United States of America.

10. Changes to Terms of Use

We may update these Terms of Use from time to time. Your continued use of NBRLY after such changes constitutes your acceptance of the updated terms.
